This Refund and Cancellation Policy ("Policy") applies to all paid subscriptions and purchases made through Crushi.ai (the "Services"), operated by Alperen LTD ("Crushi," "we," "us," or "our"). This Policy should be read in conjunction with our Terms of Service and Privacy Policy.
IMPORTANT: Crushi.ai is an adult-oriented platform exclusively for users 18 years of age or older. Special provisions apply to refunds and cancellations for adult content services as described below.
1. Subscription Types and Billing
1.1 Available Subscription Plans
We offer the following types of subscriptions:
Monthly Subscriptions:
- Billed every 30 days from the date of initial purchase
- Automatically renew unless cancelled before the renewal date
- Pricing displayed in your local currency at checkout
Annual Subscriptions:
- Billed once every 12 months from the date of initial purchase
- Automatically renew unless cancelled before the renewal date
- Typically offered at a discounted rate compared to monthly billing
Lifetime Subscriptions:
- One-time payment for permanent access (where offered)
- Non-recurring, no automatic renewals
- Subject to our continued operation of the Services
Free Trials:
- May be offered at our discretion for new users
- Typically 3-7 days in duration
- Automatically convert to paid subscription unless cancelled before trial ends
- Require valid payment method to initiate
1.2 Billing and Payment
Billing Timing:
- Subscriptions are billed in advance at the start of each billing period
- Your billing date is determined by when you first subscribed
- You will be charged immediately upon purchase or at the end of any free trial period
Payment Methods:
- Credit cards (Visa, Mastercard, American Express, Discover)
- Debit cards
- PayPal (where available)
- Apple Pay / Google Pay (for mobile app purchases)
- Other payment methods as displayed at checkout
Billing Notifications:
- We will send email reminders at least 7 days before your subscription auto-renews
- These reminders will include the renewal amount and renewal date
- Email notifications will be sent to the email address associated with your account
Failed Payments:
- If your payment method fails, we will attempt to process payment up to 3 times over 7 days
- You will receive email notifications of failed payment attempts
- Your subscription may be suspended or cancelled if payment cannot be processed
- You remain responsible for any outstanding amounts owed
1.3 Price Changes
Notification of Price Changes:
- We reserve the right to change subscription prices at any time
- For existing subscribers, price changes will take effect only upon your next renewal
- We will provide at least 30 days' advance notice of any price increase
- Notice will be sent via email to your registered email address
Your Options When Prices Change:
- If you do not agree to a price increase, you may cancel your subscription before the new price takes effect
- Cancelling before the renewal date will allow you to continue service through the end of your current billing period at the old price
- If you do not cancel, continuing to use the Services after the price change takes effect constitutes acceptance of the new pricing
2. Cancellation Rights and Procedures
2.1 Your Right to Cancel
You may cancel your subscription at any time, for any reason. The process and effect of cancellation depend on where and how you purchased your subscription.
2.2 European Union and United Kingdom Consumers - Withdrawal Rights
14-Day Withdrawal Right:
If you are a consumer residing in the European Economic Area (EEA) or the United Kingdom, you have the right to withdraw from your purchase within 14 days without giving any reason, in accordance with the EU Consumer Rights Directive and UK Consumer Contracts Regulations.
Withdrawal Period:
- The withdrawal period is 14 days from the date of purchase
- To exercise your right of withdrawal, you must inform us of your decision by sending a clear statement to [email protected]
- You may use the withdrawal form template provided below, but it is not mandatory
Effect of Withdrawal:
- If you exercise your right of withdrawal within the 14-day period, we will reimburse all payments received from you, including initial subscription fees
- Reimbursement will be made without undue delay and in any event no later than 14 days from the day we receive your withdrawal notification
- We will use the same payment method you used for the original transaction unless you expressly agree otherwise
- You will not incur any fees as a result of the reimbursement
IMPORTANT - Waiver of Withdrawal Rights for Adult Content:
By accessing and using the adult content Services immediately after purchase, you expressly request immediate access to digital content and you acknowledge and agree that:
- You waive your 14-day withdrawal right for the portion of the Services you have already consumed
- Once you begin using the Services (creating characters, generating content, viewing adult material), the withdrawal right is lost for that billing period
- This waiver is required under EU law (Consumer Rights Directive Article 16(m)) because adult digital content is performed with your explicit consent and loses the right of withdrawal once performance has begun
Partial Refunds:
- If you withdraw within 14 days but have already used the Services, you may receive a pro-rated partial refund
- The refund will be reduced by an amount proportionate to the Services already supplied
- For example, if you used the Services for 7 days out of a 30-day monthly subscription, you may receive a refund for the unused 23 days

2.3 Cancellation Procedures
The process for cancelling your subscription depends on where you purchased it:
A. Website Subscriptions (purchased at crushi.ai):
To cancel a subscription purchased directly through our website:
- Log into your account at crushi.ai
- Navigate to Account Settings > Subscription or Billing
- Click "Cancel Subscription" or "Manage Subscription"
- Follow the prompts to confirm cancellation
- Confirmation email will be sent to your registered email address

- Include your account email address and any relevant order information
- We will process your cancellation within 1 business day and send confirmation
B. Apple App Store Subscriptions (iOS):

- Select the Crushi.ai subscription

For refunds from Google:
- Request refunds through Google Play at support.google.com/googleplay/answer/2479637
- Google determines refund eligibility based on their own policies
- We cannot process refunds for Google Play purchases

2.4 When Your Cancellation Takes Effect
Access After Cancellation:
- When you cancel, you will retain access to the Services until the end of your current billing period
- For example, if you cancel on January 15 but your subscription renews on January 30, you will have access until January 30
- No refund is provided for the unused portion of the current billing period (except for EU/UK withdrawal rights as described above)
No Future Charges:
- Once cancelled, you will not be charged for any future billing periods
- Your payment method will not be charged again
- You will receive a confirmation email when cancellation is complete
Free Trials:
- If you cancel during a free trial period, you will not be charged
- Your access will continue until the end of the trial period
- After the trial ends, you will lose access to premium features
Immediate Cancellation:
- If you wish to cancel immediately and lose access right away, you may request account deletion
- Contact [email protected] to request immediate account deletion
- No refunds are provided for immediate cancellation (except EU/UK withdrawal rights)
3. Refund Eligibility and Process
3.1 General Refund Policy
Standard Policy:
All subscription payments are non-refundable except:
- Where required by applicable law (EU/UK 14-day withdrawal rights)
- In cases of billing errors or technical failures as described below
- At our sole discretion in exceptional circumstances
No Refunds for:
- Change of mind after the withdrawal period
- Failure to use the Services
- Failure to cancel before automatic renewal
- Content that you find offensive or inappropriate (you are responsible for understanding the adult nature of our Services before purchasing)
- Violation of our Terms of Service resulting in account termination
- Services that have been partially or fully consumed
3.2 Refundable Circumstances
We will provide refunds in the following situations:
A. Billing Errors:
If you were charged incorrectly due to a technical or billing error:
- Duplicate charges (charged twice for the same subscription)
- Wrong amount charged (charged more than the displayed price)
- Charged after cancellation was properly completed
- Charged despite payment method failure

- Critical features unusable for more than 7 days
- Persistent technical problems preventing reasonable use of the Services
Requirements:

- We must be unable to resolve the issue within a reasonable timeframe
- Refunds are calculated based on the downtime period only
Not covered:
- Issues caused by your internet connection, device, or browser
- Planned maintenance (with advance notice)
- Issues caused by third-party services
- Brief, isolated technical problems
C. Unauthorized Charges:
If your payment method was used without your authorization:

- File a dispute with your payment provider
- Cooperate with any investigation
- We will refund confirmed unauthorized charges
D. Age-Gated Access Issues:
If you completed age verification but were unable to access the Services due to a technical error on our part:

3.4 Prorated Refunds
When Prorated Refunds Apply:
Prorated refunds may be issued in the following situations:
- EU/UK consumers exercising withdrawal rights after partial use
- Extended service outages or technical failures
- At our discretion for exceptional circumstances
How Prorated Amounts Are Calculated:
For monthly subscriptions:
- Daily rate = (Monthly subscription price) ÷ 30 days
- Refund = (Days unused) × (Daily rate)
For annual subscriptions:
- Monthly rate = (Annual subscription price) ÷ 12 months
- Refund = (Full months unused) × (Monthly rate)
Example:
- Monthly subscription: $29.99
- Used for 10 days before cancellation
- Daily rate: $29.99 ÷ 30 = $1.00 per day
- Refund: 20 days × $1.00 = $20.00 (rounded)
Limitations:
- Prorated refunds are not automatic; they must be requested
- Minimum refund amount is €5 / $5 / £5 (amounts below this threshold will not be refunded)
- Prorated refunds do not apply to lifetime subscriptions
4. Free Trials
4.1 Free Trial Terms
Trial Duration:
- Free trial periods are typically 3-7 days as specified at signup
- The exact duration will be clearly displayed before you begin the trial
- Trial period begins immediately upon signup
Trial Eligibility:
- Free trials are available only to new users who have never subscribed before
- One free trial per user, per household, per payment method
- We reserve the right to deny free trials to users we suspect of abuse
Payment Method Required:
- You must provide a valid payment method to start a free trial
- Your payment method will not be charged during the trial period
- You will be charged automatically if you do not cancel before the trial ends
Age Verification:
- Free trials still require age verification (you must be 18+)
- Standard age-gating and verification procedures apply
4.2 Cancelling During Free Trial
No Charge Cancellations:
- If you cancel before your free trial ends, you will not be charged
- You will retain access to the Services until the trial period expires
- After the trial ends, you will lose access to premium features
How to Cancel:
- Use the same cancellation procedures described in Section 2.3
- Cancellation must be completed before 11:59 PM on the last day of your trial
- You will receive confirmation email when cancellation is complete
Trial to Paid Conversion:
- If you do not cancel before the trial ends, you will automatically be charged for a subscription
- The subscription type and price will be clearly disclosed at trial signup
- You will be charged at the beginning of your first paid billing period
Post-Trial Refunds:
- If you are charged after a free trial ends, standard refund policies apply
- EU/UK consumers have 14-day withdrawal rights from the date of charge
- You will not receive a refund simply because you "forgot to cancel" during the trial
4.3 Trial Abuse Prevention
We reserve the right to:
- Deny free trials to users with suspicious account patterns
- Deny trials to users who have previously cancelled immediately after trial periods
- Deny trials to multiple accounts from the same household or payment method
- Terminate accounts and deny refunds for fraudulent trial abuse
5. Automatic Renewals
5.1 How Auto-Renewal Works
Default Setting:
- All subscriptions (monthly and annual) automatically renew by default
- You will be charged at the start of each new billing period
- The charge amount will be the then-current subscription price
- Renewals continue until you cancel
Renewal Notifications:
- We will send reminder emails at least 7 days before renewal
- Reminders include renewal date, amount, and cancellation instructions
- Ensure your email address is current to receive these notifications
5.2 Managing Auto-Renewal
Turning Off Auto-Renewal:
- You can disable auto-renewal without cancelling your current subscription
- Access your account settings at crushi.ai
- Navigate to Subscription > Auto-Renewal
- Toggle auto-renewal off
- You will retain access until the end of your current billing period
- After the period ends, your subscription will not renew
Re-enabling Auto-Renewal:
- You can turn auto-renewal back on at any time before your subscription expires
- This will allow your subscription to continue automatically
Cancelling vs. Disabling Auto-Renewal:
- Cancelling: Terminates your subscription; you keep access until period ends
- Disabling auto-renewal: Same effect, just different terminology
- Both prevent future charges while maintaining current access
5.3 What Happens at Renewal
Successful Renewal:
- Your payment method is charged automatically
- You receive a receipt email
- Your subscription continues for another billing period
- Access to the Services continues uninterrupted
Failed Renewal:
- If payment fails, we attempt to charge your payment method up to 3 times over 7 days
- You will receive email notifications of failed payment
- If all attempts fail:
- Your subscription may be downgraded to free tier (if available)
- Or your access may be suspended/terminated
- Outstanding amounts remain payable
Updating Payment Information:
- Keep your payment method current to avoid failed renewals
- Update payment information in your account settings
- We are not responsible for failed renewals due to expired or invalid payment methods
6. What Happens After Cancellation
6.1 Immediate Effects
Access to Services:
- You retain full access to premium features until the end of your current billing period
- All features remain available during this time
- You can continue creating and accessing content
No Future Billing:
- Your payment method will not be charged again
- No renewal notices will be sent
- Subscription status will show as "Cancelled" with end date
6.2 End of Billing Period
When Your Subscription Ends:
- Access to premium features is removed
- You will be downgraded to free tier (if available) or lose all access
- Some features may become read-only or unavailable
What You Can Still Do:
- Log in to your account (account remains active)
- Access account settings
- View your cancellation and payment history
- Re-subscribe at any time
What You Cannot Do:
- Create new AI characters
- Generate new adult content or images
- Access premium-only features
- Send messages or interact with certain characters (depending on tier)
6.3 Your Content and Data
Content Created During Subscription:
- Characters you created: May be preserved but with limited functionality
- Generated content: May be preserved in read-only format for a limited time
- Chat histories: May be preserved for a limited time (typically 30-90 days)
- Saved favorites: May be preserved but some may become inaccessible
Data Retention:
- We retain your account data according to our Privacy Policy
- Personal information is retained as required by law
- You may request account deletion at any time
- Deleted accounts cannot be recovered
Public Content:
- Characters or content you made publicly available may remain on the platform
- We reserve the right to preserve publicly shared content even after cancellation
- See our Terms of Service for details on content licensing
6.4 Re-Subscribing
How to Re-Subscribe:
- Log into your account at crushi.ai
- Navigate to subscription or billing settings
- Select a subscription plan
- Complete payment
- Access is restored immediately upon payment
Previous Content:
- Depending on how long since cancellation, some of your previous content may be restored
- Content deleted per our retention policies cannot be recovered
- No guarantee of content availability after re-subscription
Promotional Pricing:
- Previous promotional rates may not apply to re-subscriptions
- Current pricing will apply
- Free trials are typically not available for returning subscribers
7. Disputed Charges and Chargebacks
7.1 Resolving Billing Disputes
Before Filing a Chargeback:
We strongly encourage you to contact us directly before disputing charges with your bank or payment provider:

- Provide documentation: order number, date, amount, reason for dispute
- Allow us to investigate: we typically respond within 5 business days
- Work toward resolution: we will attempt to resolve legitimate disputes
Benefits of Direct Resolution:
- Faster resolution than chargeback process
- Avoids damage to your payment provider relationship
- Maintains your account access
- More favorable outcome in many cases
7.2 Chargeback Policy
What is a Chargeback:
- A chargeback is when you dispute a charge directly with your bank or credit card company
- The payment provider reverses the charge and takes money from our account
- This is different from a refund requested directly from us
Our Chargeback Policy:
If you file a chargeback without first contacting us:
- Automatic account suspension: Your account will be immediately suspended pending investigation
- Content access removed: You will lose access to all premium features and content
- Investigation: We will provide evidence to your payment provider to dispute the chargeback
- Outcome:
- If chargeback is found in your favor: charge is reversed, account may remain suspended
- If chargeback is found in our favor: charge is reinstated, account remains suspended
- Account termination: Accounts with chargebacks may be permanently terminated at our discretion
Consequences:
- You may be permanently banned from creating future accounts
- We reserve the right to pursue legal action for fraudulent chargebacks
- Outstanding balances remain payable even if account is terminated
Fraudulent Chargebacks:
- Filing a chargeback for services you received and used is fraudulent
- This may constitute theft of services
- We cooperate fully with law enforcement on fraud cases
- You may be reported to payment processors and fraud databases
Legitimate Chargebacks:
- Chargebacks filed for truly unauthorized charges are acceptable
- If you did not authorize the purchase, file a chargeback and also notify us
- We will cooperate with legitimate fraud investigations
7.3 Subscription Disputes
Common Disputed Charges:
Many disputes arise from:
- Forgetting about automatic renewals
- Not cancelling before the renewal date
- Failing to receive renewal reminder emails (check spam folder)
- Misunderstanding cancellation procedures
These are NOT valid reasons for chargebacks:
- "I forgot to cancel"
- "I didn't use the service"
- "I didn't see the renewal email"
- "I don't like the content" (adult content platform - you are responsible for knowing what you're purchasing)
Valid Dispute Reasons:
- You cancelled before renewal but were charged anyway
- You were charged twice for the same period
- The amount charged does not match the stated price
- Your payment method was used without your authorization

8. Special Circumstances

8.2 Service Discontinuation
If We Discontinue the Services:
In the unlikely event that we permanently discontinue the Crushi.ai Services:
Notice:
- We will provide at least 30 days' advance notice
- Notice will be sent to all active subscribers via email
- Notice will be posted prominently on the website
Refunds:
- Subscribers will receive prorated refunds for prepaid time after the shutdown date
- For example, if we shut down 15 days into your monthly subscription, you'll be refunded for the unused 15 days
- Annual subscribers will receive refunds for complete unused months
Your Content:
- We will provide a reasonable opportunity (typically 30-60 days) to download or export your content
- After the shutdown date, content may be permanently deleted
- We are not obligated to maintain content indefinitely
No Liability:
- We are not liable for loss of access, content, or service beyond the refund described above
- No compensation for inconvenience, lost time, or other indirect damages
8.3 Death or Incapacity
Deceased User:
If a subscriber passes away:
- Estate representatives may request cancellation and prorated refund
- Must provide death certificate and proof of legal authority
- Refunds issued to the estate, not to heirs directly
- Account will be permanently closed
Incapacitated User:
If a subscriber becomes incapacitated:
- Legal guardians or power of attorney holders may request cancellation
- Must provide legal documentation of authority
- Prorated refunds may be issued at our discretion
