18 U.S.C. § 2257 Exemption Statement

1. Statement
Alperen Ltd. operates crushi.ai and the related applications and services (the “Services”). All visual content appearing on or generated through the Services is created by artificial intelligence. It is fictional, and it does not depict any actual human being.
Because the Services contain no visual depiction of an actual human being engaged in actual or simulated sexually explicit conduct, the record-keeping, labelling and inspection requirements of 18 U.S.C. §§ 2257 and 2257A and of 28 C.F.R. Part 75 do not apply to the Services or to Alperen Ltd.
2. Why those requirements do not apply
Sections 2257 and 2257A place their obligations on the producer of a visual depiction of an actual human being engaged in sexually explicit conduct. The producer must examine an identity document for each performer, record that performer's legal name and date of birth, and publish a custodian-of-records notice.
There is no performer on the Services. Every character is invented, and every image and video is generated by a model from a text description: no person is photographed or filmed, no camera records anyone, and no person's likeness is captured. There is accordingly no performer whose age could be verified and no record that could be created, because there is no actual human being in the depiction.
3. Depictions of real people are prohibited absolutely
The following are prohibited on the Services without exception:
- uploading, sharing or requesting a photograph or video of any real person in a sexual or nude context, including of yourself;
- generating or requesting content intended to resemble a real, identifiable person, whether a public figure or a private individual;
- altering an image of a real person into sexual content, including by any “deepfake” technique.
A violation results in immediate and permanent termination of the account and removal of the content, and is reported to law enforcement where the law requires it. This prohibition is the reason the statement in Section 1 holds: it is what keeps any depiction of an actual human being off the Services.
4. Minors
Any content that depicts, describes, sexualises or implies a minor is prohibited without exception, whether generated or uploaded. Generation requests are screened automatically before generation, and requests matching prohibited categories — including any indication of a minor — are rejected. Confirmed material of this kind is reported to the National Center for Missing & Exploited Children (NCMEC) through its CyberTipline and to law enforcement, and the account is terminated permanently.
